Sunday Mirror successful in first trial on “serious harm”

Judgment was handed down on 13 August in the landmark case of Cooke v MGN, referred to previously, in which we acted for the publishers of the Sunday Mirror and Birmingham Mail. Mr Justice Bean found that s.1 of the Defamation Act 2013  which requires a claimant to establish that the statement caused serious harm to reputation before it can be found to be defamatory – did raise the bar beyond the common law requirements. In the present case, it was not possible for the Claimants to rely on an inference that serious harm had been caused in the absence of any evidence of harm.
