Geneva appeal court recognises High Court costs order in Subotic libel claim

In October 2013 Mr Justice Dingemans stuck out a claim by Serbian businessman, Stanko Subotic, against former head of the Montenegrin trade mission to Washington, Ratko Knezevic, on grounds of Jameel abuse of process and ordered Mr Subotic to pay the costs. We acted for Mr Knezevic.

Years later, in resisting Mr Knezevic’s attempts to enforce the costs judgment in both France and Switzerland, Mr Subotic raised arguments against recognition of the English decision on grounds that English libel law and the Jameel jurisdiction are incompatible with Swiss and French law and Article 6 of the ECHR. Such arguments have been rejected by the French courts and more recently by the Swiss courts with the judgment being recognised in both countries. The enforcement action in both jurisdictions continues. So far Mr Subotic has paid nothing.
