We acted for the defendants in the long-running case of Joseph v Spiller, which made history when the Supreme Court rebranded the defence of fair comment as “honest comment”. Mr Justice Tugendhat found that the defendants had not successfully proved the truth of two allegations published on the website of 1311 Events, and did not believe the opinions expressed there. However, the claimants were awarded damages of only 1p after one of them was found to have misled the court. In addition, they were ordered to pay 75 per cent of the defendants’ costs in the litigation.
